Moun — Terms and Conditions

These Terms and Conditions (“Terms”) govern your access to and use of the Moun mobile application, the website at https://moun.app, and related services (the “Service”). The Service is operated by Zima LLC (“Zima,” “we,” “us,” or “our”).
By downloading, accessing, or using Moun, you agree to these Terms and to our Privacy & Security Policy. If you do not agree, do not use the Service.
1. Definitions
“Moun” or the “Service” means the Moun app and its features, including voice and text chat, reminders, location-based reminders, Memory Cards, optional calendar connection, subscriptions, and related functions.
“You” means the individual who uses the Service.
“User Content” means anything you create or store in Moun: chat messages, photos, voice recordings and transcripts, reminders, Memory Cards, saved places, and similar data.
“Third-Party Services” means providers we use to operate Moun (hosting, AI, speech-to-text, analytics, payments, maps, calendars), as listed in the Privacy & Security Policy.
2. Eligibility
You must be at least 13 years old (or the minimum digital-consent age in your country, if higher). If you are under the age of majority where you live, you may use Moun only with a parent or guardian’s involvement and consent. By using the Service you represent that you meet these requirements and can enter into these Terms.
3. Account
Most features require an account. You may register with Sign in with Apple, Sign in with Google, or email and password. You agree to:
provide accurate information;
keep your credentials confidential;
be responsible for activity under your account;
tell us promptly if someone uses your account without permission.
We are not liable for loss caused by your failure to protect your account.
4. License
If you follow these Terms, Zima grants you a limited, personal, non-exclusive, non-transferable, revocable license to install and use Moun on devices you own or control, for your own personal, non-commercial use. We reserve all other rights.
5. Subscriptions, trial, and billing
Trial. We may offer a short free trial (currently three days after you decline a paywall, unless we state otherwise in the app). When the trial ends, paid features require a subscription unless we say otherwise.
Free or limited use. We may offer a free or limited mode. We may change what is included, and we may set usage limits (for example on assistant messages) to keep the Service reliable.
Paid subscriptions. Some features require a paid subscription. Purchases are sold and billed by the Apple App Store or Google Play and follow those stores’ rules. Zima does not store your full payment card number. Paywalls may be shown using Superwall.
Renewal. Subscriptions renew automatically at the then-current price unless you cancel in your Apple or Google account settings before the renewal date.
Cancel and refunds. Cancel anytime through the store. Refunds are handled by Apple or Google under their policies. Zima generally does not refund store purchases itself.
Price changes. We may change prices for future periods. Where law or store rules require notice, we will give it.
6. Your content
You own your User Content. Zima does not claim ownership of your reminders, Memory Cards, photos, or messages.
License we need to run Moun. You grant Zima a worldwide, non-exclusive, royalty-free license to host, store, encrypt, decrypt, transmit, transcribe, embed, index, and display User Content only to operate and improve the Service for you. That includes sending what is reasonably needed to Third-Party Services (speech-to-text, AI, storage, calendars) as described in the Privacy & Security Policy.
Your responsibility. You are responsible for User Content and for having the right to store it in Moun. Do not upload anything illegal or that infringes someone else’s rights.
Not a vault. Moun is a memory and reminder tool. It is not a zero-knowledge safe. Do not store passwords, government IDs, or full bank account numbers in it.
7. Acceptable use
You must not:
use Moun for anything unlawful, harmful, or fraudulent;
store content that is illegal, infringing, or that violates someone else’s privacy;
try to access other accounts or our systems without permission;
reverse engineer the Service except where the law allows it;
disrupt or overload the Service;
use bots or scrapers in a way that exceeds ordinary human use;
resell or commercially exploit Moun without our written permission.
We may suspend or terminate accounts that break this section.
8. AI and no professional advice
The assistant can transcribe speech, understand photos, create reminders and Memory Cards, and answer questions about your own data. Output can be wrong, incomplete, or outdated. Check anything important yourself.
Moun does not give medical, legal, financial, or other professional advice. Do not rely on Moun alone for health, safety, or time-critical matters. Reminders and alarms can fail (device off, no network, OS limits, denied permissions).
9. Location and notifications
Location reminders need location permission (often including background location). Accuracy depends on the device and OS. We do not guarantee a reminder will fire at the exact time or place. Notifications and alarms need the permissions you grant and the OS settings you leave on.
10. Third-party services
Moun depends on Third-Party Services (including Apple, Google, Anthropic, speech-to-text providers, Superwall, and our host). Their terms and privacy policies may also apply. We are not responsible for their outages, acts, or content.
11. Our intellectual property
The Service, the Moun name, branding, design (including the character/orb), software, and related IP belong to Zima LLC or its licensors. These Terms do not transfer those rights except the limited license in Section 4.
12. Feedback
If you send ideas or feedback, you grant Zima a perpetual, irrevocable, royalty-free right to use them without paying you or crediting you.
13. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. ZIMA DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT DATA WILL NEVER BE LOST. YOU USE MOUN AT YOUR OWN RISK.
14. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ZIMA LLC AND ITS OWNERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ZIMA’S TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) WHAT YOU PAID ZIMA FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM, OR (B) USD $50.
Some places do not allow these limits. In that case they apply only as far as the law allows.
15. Indemnity
You will indemnify and hold harmless Zima LLC and its owners, employees, and suppliers from claims, damages, and reasonable legal fees arising from your User Content, your use of the Service, or your violation of these Terms or of someone else’s rights.
16. Termination
You may stop using Moun and delete your account at any time. We may suspend or end access if you violate these Terms, if the law requires it, or if we shut down the Service. When access ends, your license ends. Sections that should survive (including ownership, disclaimers, liability limits, and indemnity) survive.
17. Changes
We may change, pause, or stop any part of the Service. We may update these Terms. For material changes we will give reasonable notice (in the app or by email). If you keep using Moun after the change, you accept the new Terms.
18. Governing law
These Terms are governed by the laws of the United States, without regard to conflict-of-law rules. Except where consumer law in your country of residence says otherwise, disputes will be heard in courts of competent jurisdiction in the United States. Nothing here limits mandatory consumer rights you have where you live.
If Zima LLC is organized under the laws of a particular U.S. state, the laws of that state apply to the extent they are not inconsistent with the previous paragraph.

These Terms are the entire agreement between you and Zima LLC about the Service and replace prior agreements on the same subject.
If a translation conflicts with the English version, the English version governs.
