Moun — Terms and Conditions

These Terms and Conditions ("Terms") govern your access to and use of the Moun mobile application, website at moun.app, and related services (collectively, the "Service"). The Service is operated by Zima LLC ("Zima," "we," "us," or "our").
By downloading, accessing, or using Moun, you agree to be bound by these Terms and by our Privacy & Security Policy. If you do not agree, do not use the Service.
1. Definitions
"Moun" or the "Service" means the Moun application and all associated features, including voice capture, notes, reminders, location-based reminders, calendar features, AI-assisted search, and any related functionality.
"User," "you," or "your" means the individual who accesses or uses the Service.
"User Content" means any notes, text, voice recordings, transcriptions, images, reminders, and other information you create, upload, or store in Moun.
"Third-Party Services" means services provided by companies other than Zima that Moun uses to operate (for example, cloud hosting, artificial intelligence, speech, search, and calendar providers), as described in our Privacy & Security Policy.
2. Eligibility
You must be at least 13 years old (or the minimum age of digital consent in your country, if higher) to use Moun. If you are under the age of majority in your jurisdiction, you may use Moun only with the involvement and consent of a parent or legal guardian. By using the Service, you represent and warrant that you meet these requirements and that you have the legal capacity to enter into these Terms.
3. Your Account
To use most features of Moun, you must create an account. You may register using Sign in with Google or another supported authentication method. You agree to:
Provide accurate and complete information;
Keep your login credentials secure and confidential;
Be responsible for all activity that occurs under your account; and
Notify us promptly of any unauthorized use of your account.
We are not liable for any loss or damage arising from your failure to safeguard your account credentials.
4. License to Use Moun
Subject to your compliance with these Terms, Zima grants you a limited, personal, non-exclusive, non-transferable, revocable license to download and use Moun on devices you own or control, for your own personal, non-commercial use. All rights not expressly granted to you are reserved by Zima.
5. Subscriptions, Billing, and Free Tier
Free tier. Moun offers a free tier with limited features. We may change the features included in the free tier at any time.
Paid subscriptions. Certain features require a paid subscription. Subscriptions are sold and billed through the Apple App Store or Google Play Store, and are subject to those platforms' terms and payment policies. Zima does not directly process or store your payment card details.
Auto-renewal. Unless otherwise stated, subscriptions renew automatically at the end of each billing period at the then-current price, unless you cancel before the renewal date through your App Store or Google Play account settings.
Cancellation and refunds. You may cancel your subscription at any time through your app store account. Refunds are handled by Apple or Google in accordance with their respective policies. Zima generally does not provide direct refunds for purchases made through these platforms.
Price changes. We may change subscription prices. Any price change will apply only to billing periods after the change and, where required by law or platform rules, only after notice to you.
6. User Content and Ownership
You own your content. You retain all ownership rights to your User Content. Zima does not claim ownership of your notes, recordings, images, or other content.
License to operate the Service. To provide Moun, you grant Zima a worldwide, non-exclusive, royalty-free license to host, store, process, transmit, transcribe, analyze, and display your User Content solely for the purpose of operating and improving the Service for you. This includes sending relevant content to the Third-Party Services described in our Privacy & Security Policy so that features such as transcription, semantic search, AI reasoning, image analysis, and voice output can function.
Responsibility for content. You are solely responsible for your User Content and for ensuring you have the right to store and process it through Moun. You must not upload content that infringes the rights of others or violates any law.
Sensitive information notice. Moun is designed as a personal memory and productivity tool, not a secure vault for highly confidential data. You should not store passwords, government identification numbers, full financial account numbers, or other highly sensitive information in unprotected notes. See the Privacy & Security Policy for details on how data is processed.
7. Acceptable Use
You agree not to:
Use Moun for any unlawful, harmful, fraudulent, or abusive purpose;
Upload or store content that is illegal, infringing, defamatory, or that violates the privacy or rights of others;
Attempt to gain unauthorized access to the Service, other users' accounts, or our systems;
Reverse engineer, decompile, or attempt to extract source code from the Service, except where permitted by law;
Interfere with, disrupt, or overload the Service or its infrastructure;
Use automated systems (bots, scrapers) to access the Service in a manner that sends more requests than a human could reasonably produce; or
Resell, sublicense, or commercially exploit the Service without our written permission.
We may suspend or terminate access for any violation of this section.
8. AI Features and No Professional Advice
Moun uses artificial intelligence to transcribe voice, organize notes, generate reminders, analyze images, and answer questions about your own content. AI-generated output may be inaccurate, incomplete, or misinterpreted. You should independently verify anything important.
Moun does not provide medical, legal, financial, psychological, or other professional advice. AI features are provided for personal organization and convenience only, and should not be relied upon as a substitute for professional judgment. Do not rely solely on Moun's reminders or notes for time-critical, health-critical, or safety-critical matters.
9. Location-Based Features
Moun offers optional location-based reminders (geofencing). These features require you to grant location permissions to the app. Location accuracy depends on your device and operating system, and we cannot guarantee that a location-based reminder will always trigger at the exact moment or place intended. You are responsible for enabling the permissions these features require.
10. Third-Party Services
Moun relies on Third-Party Services to function, and integrates with services such as Google (including Sign in with Google, Google Calendar, and Google Maps/Places where applicable). Your use of those integrations may also be subject to the third party's own terms and privacy policies. Zima is not responsible for the acts, omissions, availability, or content of Third-Party Services. A list of the main providers is available in our Privacy & Security Policy.
11. Intellectual Property
The Service, including its software, design, "Moun" name and branding, visual identity (including the animated orb), text, graphics, and all related intellectual property, is owned by Zima LLC or its licensors and is protected by applicable intellectual property laws. Nothing in these Terms transfers any such rights to you, except for the limited license to use the Service granted above.
12. Feedback
If you send us ideas, suggestions, or feedback about Moun, you grant Zima a perpetual, irrevocable, royalty-free license to use that feedback for any purpose without obligation to you.
13. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. ZIMA DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR THAT DATA WILL NEVER BE LOST. YOU USE THE SERVICE AT YOUR OWN RISK.
14. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ZIMA LLC AND ITS OWNERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ZIMA'S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID ZIMA FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM, OR (B) USD $50.
Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
15. Indemnification
You agree to indemnify and hold harmless Zima LLC and its owners, employees, and suppliers from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your User Content, your use of the Service, or your violation of these Terms or any law or third-party right.
16. Termination
You may stop using Moun and delete your account at any time. We may suspend or terminate your access to the Service, with or without notice, if you violate these Terms, if required by law, or if we discontinue the Service. Upon termination, the licenses granted to you end. Sections that by their nature should survive termination (including ownership, disclaimers, limitation of liability, and indemnification) will survive.
17. Changes to the Service and These Terms
We may modify, suspend, or discontinue any part of the Service at any time. We may also update these Terms from time to time. If we make material changes, we will provide reasonable notice (for example, through the app or by email). Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
18. Governing Law and Disputes
These Terms are governed by the laws of the State of [STATE OF FORMATION / GOVERNING STATE], United States, without regard to its conflict-of-laws principles. You agree that any dispute arising out of or relating to these Terms or the Service will be subject to the exclusive jurisdiction of the state and federal courts located in [COUNTY, STATE], except where prohibited by applicable law. Nothing in this section limits any mandatory consumer protection rights available to you in your country of residence.

These Terms and Conditions constitute the entire agreement between you and Zima LLC regarding the Service and supersede any prior agreements.
